EVQ Public Benefit Corporation (“EVQ,” “we,” “our,” or “us”) provides a car shopping tool designed to help consumers compare vehicles and connect with dealers offering cars that meet their needs.

By using our website, mobile application, or any related services (collectively, the “Services”), you agree to these Terms of Use. Please read them carefully before using the Services.

1. Acceptance of Terms

   By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

2. Services Provided

   EVQ provides access to vehicle listings and connects interested consumers with participating dealers. EVQ is not a car dealer, broker, or lender. Vehicle listings and pricing are provided by third parties, and EVQ does not guarantee their accuracy.

3. User Information and Dealer Contacts

   When you submit your name, email address, or phone number to inquire about a vehicle, you authorize EVQ to:

   • Share your contact information with the dealer listing that vehicle so they can contact you about your inquiry
   • By submitting your information, you represent and warrant that you have provided notice and obtained any necessary consents to provide your User Data (including name and contact information) to EVQ, participating dealers (ASI Subscribing Dealers), Service Vendors, OEMs (Original Equipment Manufacturers), and other authorized parties for the purpose of purchasing a new or used vehicle, including the ability of these parties to directly contact you for the aforementioned purpose.

   You may opt out of marketing communications at any time by following the unsubscribe instructions in any email or contacting us at privacy@evqengage.com.

4. No Warranty

   EVQ provides the Services “as is.” We make no warranties or representations about the accuracy, completeness, or reliability of vehicle listings or dealer information.

5. Limitation of Liability

   To the maximum extent permitted by law, EVQ is not liable for any indirect, incidental, or consequential damages arising from your use of the Services or reliance on third-party listings.

6. Changes to Terms

   EVQ may update these Terms from time to time. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

7. Governing Law

   These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws principles.
